Qualifications
BA (Hons) Durham
James joined Chambers in 2007, having previously practised from 2 King’s Bench Walk, Temple and then King’s Bench Chambers in Plymouth. He has a busy practice, which focuses on all aspects of civil law especially disputes involving land, contractual disputes and personal injury disputes.
Property
James regularly acts in cases involving the registration, ownership and use of land; whether in boundary disputes, disputes over rights of way, and easements, cases involving estoppel or orders for sale. James also has considerable experience in disputes between cohabitees or other family members who seek to establish or deny interests in property.
James accepts instructions in the High Court, County Court and the Upper Tribunal (Lands Chamber).
Housing
James acts for both landlords and tenants.
Accidents
James has a broad personal injury practice covering employer’s liability (including industrial disease and psychiatric injury); occupier’s liability and defective premises; holiday claims (as well as accidents abroad generally); Animals Act cases; road traffic accidents; Fatal Accidents Act claims brought on the part of dependants; and product liability / Sale of Goods Act claims. He acts for claimants and defendants in the County Court and High Court and has experience of inquests, mediations and specialist tribunals such as the Criminal Injuries Compensation Authority.
Probate Wills and Trusts
James has advised estates and beneficiaries in actions relating to the Inheritance Act and in relation to technical applications such as Beddoe’s applications.
Commercial Litigation
James has advised in commercial contractual disputes acting both for businesses and their dissatisfied customers. He has long experience of hire purchase claims and other similar actions.
James has appeared on a wide range of interim applications, including applications for freezing and interim injunctions, summary judgment, default judgment, interim payments, specific disclosure, the provision of further information, unless orders and third party costs orders. He is regularly instructed to act on behalf of businesses in Mediations.
