Robert joined Southernhay as a pupil in 2001. He has an exclusively civil practice and specialises in traditional Chancery work that ranges from insolvency to the construction of Wills.
Probate, Wills and Trusts
Robert has developed an extensive practice in contentious probate and has conducted numerous seminars on the subject. He advises clients in relation to the entire field of contentious probate, including testamentary capacity, want of knowledge and approval, undue influence and fraud. Robert acts for both personal representatives who are faced with a potential claim against the estate and for claimants who are seeking to establish that the Will is invalid. He is also instructed by both claimants and defendants in applications under the Inheritance (Provision for Family and Dependants) Act 1975.
Property
Robert specialises in all aspects of land law including easements, restrictive covenants, boundary disputes and mortgages; he is also regularly asked to advise whether there has been professional negligence in relation to this area of law. Robert appears frequently in county courts and has appeared in the Court of Appeal both in a boundary dispute and a right of way action. Robert advises on every aspect of trusts of land, including the establishment and quantification of beneficial interests, equitable accounting and the removal of trustees. He appears in county courts throughout the west county and has twice appeared in the Court of Appeal in this area of law (detrimental reliance and equitable accounting).
Housing
Robert acts for both landlords and tenants in relation to both residential and commercial leases. He frequently acts for tenants who face claims for possession as well as ASBIs and also acts for appellants in appeals under section 204 of the Housing Act 1996.
